Preliminary hearing set in bison case

Texas businessman Jeff Hawn, accused of arranging for the slaying of 32 bison in March, will appear in Park County Combined Court on Sept. 15 for a preliminary hearing.

Hawn, chief executive officer of Seattle-based Attachmate Corp., declined to comment on the case at a hearing on Aug. 4.

Attachmate is a large software company that made a $495 million acquisition in 2006.

Hawn and his attorney, Denver-based Pamela Mackey, appeared before the court to schedule the Sept. 15 preliminary hearing.

District Attorney Molly Chilson said the preliminary hearing would be to determine if there is probable cause in the case.

She declined to comment further on the case.

"I can't make any statement about it," she said.

According to court documents, Hawn allegedly hired hunters to kill bison belonging to Hartsel rancher Monte Downare after the animals repeatedly crossed over from Downare's property onto Hawn's, causing damage.

The hunters were hired through Hawn's ranch manager, John Norman.

One of the hunters, Antonino Salcedo of the Atzlan Native Community in Gardner, was told to remove the bison from the property.

In a Feb. 25 letter to Salcedo, Hawn authorized Salcedo and his colleagues to remove the buffalo from his ranch.

"You may hunt them and remove them or you may remove them live and take them to a location of your choice," the letter said.

A civil lawsuit was filed in March by Hawn against Downare seeking damages caused by the bison walking on his property.

"On numerous separate occasions, herds of buffalo have broken through the fence and stampeded onto Property to graze on the grass. The damage that the Defendants' buffalo have caused to the Property is staggering," the lawsuit said.

It alleges that the bison killed trees, that solar panels had been damaged and TV and satellite Internet dishes had been knocked offline by the bison.

Hawn turned himself in to the Park County Sheriff's Office on May 12. He is now out on bond.
