| 1/4/2010 2:47:00 PM | Email this article Print this article | Charges in starving dog case to come Jan. 26 Samuel and Diane Walker appeared in court on Jan. 4 The Florissant couple charged with animal cruelty after about 100 starving dogs and eight dead dogs were found on their property will be formally charged in the case at a Jan. 26 hearing.
Samuel and Diane Walker were in Park County Combined Court on Jan. 4 for a bond hearing. No attorney has filed for either party, but the husband and wife told the court each would have a seperate attorney.
The Walkers declined to comment on their case to The Flume while exiting the courtroom.
They were arrested on two counts of felony aggravated cruelty to animals and 30 counts of misdemeanor cruelty to animals on Dec. 25.
They turned themselves in to the Park County Jail on Dec. 25 after an investigation by Park County sheriff's deputies and animal control officers uncovered dozens of emaciated dogs and eight dead dogs on their property west of Guffey and southeast of Hartsel.
Judge Stephen Groome, who is presiding over the case in Fairplay, told the Walkers in court that, based on the arrest charges, if convicted they each could be sentenced to six months to four years in prison for each of the felony counts and six months to two years for each of the misdemeanor counts.
In a follow-up interview with The Flume, Deputy District Attorney Katie O'Brien cautioned that the presumptive minimum and maximum sentences read by Groome in court were based on arrest charges, and the charges the Walkers will face could be different when they are filed by the District Attorney's office.
O'Brien also said that she planned to motion the court to combine the cases, unless it caused a conflict between the two defendants. She said a conflict could occur if both were going to point fingers at one another.
"It seems not to be an issue here," she said.
