By way of introduction, the Home School Legal Defense Association is a nonprofit organization dedicated to protecting the right of parents to educate their children at home. We presently have over 85,000 member families across the country, with nearly 2,000 families in the State of Colorado. We have a number of members in the Park County School District.

The "Notice to homeschoolers" printed under the Community Corner section of The Flume on Aug. 21, 2009, contained inaccurate information. The notice stated that homeschoolers residing in the Park County School District must send Superintendent Chuck Soper their notice of intent to homeschool. Superintendent Chuck Soper further clarified in his notice posted on Sept. 4, 2009, that the notice could not be sent to any other district. This is incorrect.

Home-based education in Colorado is governed by Section 22-33-104.5 of the Colorado Revised Statutes. Because HSLDA helped draft the present law and was involved in testifying on its behalf, I am very familiar with its requirements. Subsection (3)(e) states in part that the parent "shall certify, in writing, only a statement containing the name, age, place of residence, and number of hours of attendance of each child enrolled in said program. In subsection (3)(e), the parent is required to "provide written notification of the establishment of said program to a school district within the state..." The wording of this statute makes it clear that the notification does not have to be filed with the school district of residence, but merely with any school district in Colorado.

We trust this information clarifies any confusion families may have had about homeschooling in Park County School District.
